Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Main Street Commodities Intelligence Platform at dashboard.mscip.com (the “Service”), operated by Oak Grove Data (“we,” “our,” or “us”). By accessing or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 and have the legal capacity to enter into these Terms.

The Service is offered to users in the United States. You agree that you are accessing the Service in the United States or that you assume responsibility for compliance with the laws of any other jurisdiction from which you access the Service.

2. The Service

The Service provides commodity market data, government data summaries, indicators, and related research and information content. The Service is provided for informational and research purposes only.

The Service is not investment advice. Oak Grove Data is not a registered investment adviser, broker-dealer, financial planner, or financial advisor. We do not provide personalized financial, investment, legal, or tax advice. Information shown on the Service may be delayed, inaccurate, or incomplete. Past performance is not indicative of future results. All trading, investment, and financial decisions are solely your responsibility.

You assume all risk associated with any decision you make based on information you obtain from the Service.

3. Account creation

To access subscription features, you must create an account by completing a paid subscription. Your account is created using the email address you provide at checkout. You are responsible for:

  • Providing accurate information at signup
  • Keeping your account credentials secure
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access

You may not share your account with others. You may not use the Service through automated means or scrape its content.

4. Subscriptions and billing

We currently offer the following paid subscription:

MSCIP Pro at $9.00 USD per month or $90.00 USD per year, billed automatically through Stripe.

By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Subscriptions renew automatically at the end of each billing period.

You can cancel your subscription at any time through the customer portal accessible from your account page. Cancellation takes effect at the end of your current billing period; you retain access to paid features until then. We do not provide refunds for partial billing periods except as required by applicable law.

Prices and features are subject to change with reasonable notice (at least 30 days before a renewal).

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Resell, redistribute, or commercialize data or content from the Service to third parties
  • Scrape, harvest, or use automated means to extract data beyond normal user interaction
  • Attempt to access portions of the Service to which you are not entitled
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with the operation of the Service or attempt to circumvent security measures
  • Use the Service to develop a competing product or service

We may suspend or terminate your account for violations of these terms.

6. Intellectual property

The Service, including its software, design, content, branding, and underlying data compilations, is owned by Oak Grove Data and protected by US and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business use during your active subscription. This license does not include any right to redistribute, sublicense, or commercialize the Service or its content.

Third-party data displayed on the Service (such as government datasets, market data, and news content) remains the property of its respective owners and is subject to its own terms.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Data displayed on the Service is accurate, current, or complete
  • The Service will meet your specific requirements

You use the Service at your own risk.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OAK GROVE DATA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Oak Grove Data from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

You may stop using the Service at any time and cancel your subscription as described in Section 4.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms, non-payment, or our discontinuation of the Service.

Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including Sections 6, 7, 8, 9, and 11) will survive.

11. Governing law and dispute resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved through informal discussion shall be resolved exclusively in the state or federal courts located in Virginia. You consent to the personal jurisdiction of those courts and waive any objection to venue.

You and Oak Grove Data each waive the right to a jury trial and the right to participate in a class action.

12. Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel any active subscription.

13. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oak Grove Data regarding the Service and supersede any prior agreements between us. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
